Sub: Payment of Fixed Medical Allowance
– Relaxation to extant instructions-reg.

The undersigned is directed to refer to
NFIR’s letter No. II/13A/part.II dated 30.03.2019 and to state that Board’s
letter No. 2011/H/28/1/RELHS/Court Case dated 31-5-2012 declaring joining
RELHS-97 mandatory for all retiring Railway pensioners without any exit clause
do not prohibit Railway pensioners/family pensioners from availing FMA or OPD
treatment whatsoever. The criteria of distance laid down to avail FMA for
Railway pensioners/family pensioners residing beyond 2.5 kms from a Railway
hospital/health unit has been issued in compliance of the judgement dated
17-11-2006 of the Hon’ble Supreme Court dismissing SLP No. 21230/2003 arising
out of Kerala High Court’s order dated 22-11-2002, the Railway pensioners/family
pensioners residing beyond 2.5 kms from a Railway hospital/health unit were
granted option for FMA. In compliance of the said order of Hon’ble Court,
instructions were issued vide Board’s letter dated 01-3-2004 (RBE No. 45/2004)
prescribing the condition of residing beyond 2.5 kms from the nearest Railway
Hospital/health unit. As such this Ministry cannot take any unilateral decision
to delete the term ‘nearest health unit’ in the undertaking to be submitted by
the Railway pensioners/family pensioners to avail FMA.

In view of the above, Federation may
please appreciate the position.
